Legal claim is one of two regarding Mexico's territory

The deterioration in relations between Mexico and the United States has triggered a couple of claims over the countries’ common border, one of which would put into question the ownership of five U.S. states and parts of four others.

A prominent Mexican politician and a lawyer yesterday proposed a legal claim that would invalidate the treaty with which Mexico surrendered half its territory to the United States.

Former Mexico City mayor and three-time presidential candidate Cuauhtémoc Cárdenas and lawyer Guillermo Hamdan Castro argue that the 1848 Treaty of Guadalupe Hidalgo fails several tests as to its validity.

The treaty gave the U.S. what is now California, New Mexico, Arizona, Nevada and Utah and parts of Colorado, Wyoming, Kansas and Oklahoma.

Hamdan said during a presentation in Cuernavaca, Morelos, yesterday that the most important element is in the accord’s first sentence, which contains an admission that the U.S. army invaded Mexico. Signing an agreement in that context renders it null, he said.

Another legal factor is that the agreement ceding Mexico’s territory was signed under pressure.

Hamdan conceded it would be impossible for Mexico to recover the lost territory should the legal claim be upheld, but suggested instead the U.S. should pay compensation for the use of the land over the last 168 years.

But given that the dollar “has meant nothing since the 1970s,” he observed, payment should be in gold or pesos. No amount was stated.

Cárdenas, a founder of the leftist Democratic Revolution Party, and Hamdan are calling on Mexicans to join them in a march to Los Pinos, official residence of President Enrique Peña Nieto, to present the proposal.

Hamdan said the president is the only person who can take the claim before the International Court of Justice.

The second claim is that 430 kilometers of the border was incorrectly marked, meaning that about 85,000 hectares now in Arizona and New Mexico actually belong to Mexico.

The claim has been made by Senator Patricio Martínez, a former governor of Chihuahua, who discovered the mistake in the 1990s. In the mid-19th century, he said, piles of stones were used to mark the border.

But towards the end of the century Mexico found the cairns had been destroyed and parts of the border marked too far south, according to a report today by the Financial Times.

Martínez’ discovery was based on an engineer’s report. A second study conducted since has confirmed the finding, he said. Now he plans to file a motion in the Senate to have the mistake corrected.

He said the matter was raised by Mexico in a letter to the Secretary of State in 1897, but was subsequently forgotten.

      The exodus to the U.S. was probably at it’s peak during the ugliest of the “war on drugs”. A war created by the Mexican government on behalf of the U.S. A BIG mistake by Felipe Calderon, and the U.S. I mean, Americans LOVE their drugs, why not just let them have them? (well, it seems those 100,000+ deaths were all for nothing, since the U.S. is legalizing marijuana now, so I guess the U.S. was just trolling Mexico, LOL?)

      Trump always whines about how Mexico is not “sending their best” (but what he really means, is “only poor people are coming, and I hate the poor!”) But during the worst of the (still ongoing) war on drugs, a lot of the people that left Mexico were pretty much forced to go to the U.S. since they had no choice, since extortionists were taking over their businesses. (it was either they leave everything behind, or wait to get murdered by the cartels, and boy, did a lot of those business owners got murdered)

      So you see, Mexico did in fact “send a lot of their best” during that period (A.K.A. not poor people)

      TL;DR.-

      Trump doesn’t really have a problem with Mexicans, per se. He just really doesn’t like poor people (which is what most Mexicans happen to be, oh well!)

      P.S.- In case you haven’t noticed, this is Mexican politicians being nonsensical. Maybe not as much as Trump has been with the wall, but that’s all this is.

      The only difference here is that this is satire, and Trump is actually serious. (which is why it’s so hard for even shows like South Park to make fun of him properly)

        The price paid in the peace treaty of 1848 after the Mexican American war was 15 million dollars for the land given up in the peace treaty.. 10 million was paid in 1853 for the Gadsen purchase so that the U.S. could run the tracks for the southern branch of the transcontinental railroad so yes both pieces of land were paid for I don’t know where your getting your faulty historical information from you’d better study some more, before you make yourself look like a complete fool..

            My post didn´t mention Mexico City, though I think some rust belt cities could be considered as bad. Safe to say most parts of Merida and San Miguel de Allende, for example, are first world and they´re better than many US cities. Albañiles in Merida work for about 350 – 400 pesos/day, less than that in nearby villages, but 700 pesos/day is common on the Riviera Maya. If anyone is working for minimum wage, they might considering looking into working in Merida. for example. There are help wanted signs all over the central part of the city, and the lowest I´ve ever heard of anyone getting paid is 100 pesos/day. 100 pesos/days was when they first started and a company would have a very hard time finding anyone to work for that in Merida.

            The minimum wage in Mexico is 75 pesos a day less than 4.00 dollars a day get your facts straight most states in the U.S. now have 10.00 an hour minimum wages please don’t try to compare apples with oranges you sound silly!     Every single time that I read comments here I find so many people reading about Mexico’s news who hate Mexicans and Mexico. Why in the world do you waste your time and energy reading when there is so much hatred towards my country?
    Now if the news is something in favor of Mexico, the negative comments intensify. Cooncats, Larry, TioDon to name a few, spew out negativity and hatred. They seem to think they know all about Mexico. I would really like for these people to go comment about what is going on in the US and leave my country alone.
    And don’t give me freedom of speech. Your behavior shows a tremendous lack of anything positive in your way of being.

Your comment is about having Mexicans legally in the country, but US has created that problem. First, too many people are willing to employ illegals because it’s cheaper. Second, trying to immigrate legally is almost impossible. I know people who have been waiting for over 15 years to get their papers after being approved. So, that problem was brought about by the US and no one else.
        Having people say that Trump should dump bombs on Mexico is not showing hatred?
        Read the comments carefully and with an open mind. Then tell me if the are truly only a critique. Verdad?

By the way every country has a right to create its own immigration laws it could take 20 years to get in, if that is the law you either abide by it or you are a criminal illegal is illegal.             Either if each country can write its own laws or not, you need to follow the treaties as well that you have currently mentioned and breaking them will only create more divisionism. For one, telling whether someone is illegal or not infringes with the guarantees in the treaty made in 1848.

    There may be merit to the argument if it is true that a treaty signed under duress has no value. Santa Anna was certainly forced to sign Texas Independence on 2 March 1836, and it is doubtful that he had the authority to sell La Mesilla (the Gadsden Purchas) in 1853.

    The map attached to this story greatly exaggerates the historic size of Texas which, prior to annexation, ended at about the 100th meridian or the eastern border of the Panhandle.

    The United States negotiated with Spain, following the Louisiana Purchase, of the western border of that territory The US claimed that border was the Rio Grande (Rìo Bravo in Spanish), while Spain said the western border of Louisiana was the west bank of the Mississippi River and the cities of New Orleans and St. Louis.

    The dispute was settled by the Adams-Onis Treaty of 1819 which defined the western boundary as the Sabine River north from the Gulf of Mexico to the 32nd parallel north, then due north to the Red River, west along the Red River to the 100th meridian west, due north to the Arkansas River, west to its headwaters, north to the 42nd parallel north, and finally west along that parallel to the Pacific Ocean.

    That boundary specifically excluded Texas from having been part of the Louisiana Purchase but following the Mexican War of 1847 the United States annexed the present Southwest and extended the western and southern borders of the Republic of Texas from the 100th meridian to its claims following the Louisiana Purchase. That, by the way, is the base of Texas debatable claim to have ever been under the French flag.

    First all wars end where the peace treaties are signed under duress!! World War 1, WW 2 and any other war you’d like to mention. The victors in a war always force the defeated literally at gun point to sign a treaty! Now the World Court in The Hague is a joke, bring your case to the court and the U.N. see how far you’ll get! The U.S. government will just veto anything that goes through the security council and laugh at the so called World Court!! It is funny how English speaking countries are so successful Canada, Australia, New Zealand and last, but not least the U.S. Britain knew how to colonize and create real freedom and value!! On the other hand look at the failure of Spain’s colonies Mexico, Bolivia, Peru, Ecuador etc!!! Not only Mexicans, but all of Latin America needs to stop blaming everyone else for their failure as countries!!
    If Mexico tried to get back any of this land they’d run into thousands of planes, tanks and other high tech weapons I’d hate to see what Mexico City would look like after 1,000 U.S. bombers came over and delivered a few nights worth of presents! As bad as Mexico City can, be believe me there would be nothing left standing !! There is an old saying don’t start something that you can’t finish.. Usually a country is under occupation until the losing country signs said treaty. Just look at the final outcome of the Franco-Prussian war of 1870 and the other wars I mentioned in my previous comments.

    This is a hundred years too late, I can’t believe how Mexico has been so abused by the US, the Alamo was not about freedom it was slavery, they were taking in boats loaded with slaves avoiding the higher taxes imposed by the north, Mexico was a free country no slaves allowed, there only mistake was stupid Santa Ann executing D.C. and J.B. that pissed off the farmers in the south that knew they were going to pay more for slaves.

    I agree with this claim, furthermore the treaty stipulated that the rights and property of Mexicans in the invaded territories were going to be respected which did not happen, so that is another violation of the treaty making it invalid.
